Form I-765 is the application for an Employment Authorization Document (EAD) — the physical card a noncitizen needs to prove they can legally work in the United States. We prepare the I-765 at the applicant's direction, picking the correct eligibility category based on your status and gathering the supporting evidence.
Common eligibility categories we prepare
- (c)(8) — Pending asylum applicant. Eligible 150 days after I-589 is filed, plus the 30-day clock, with no I-589 denial.
- (c)(9) — Pending I-485 adjustment-of-status applicant. Concurrent filing common with family-based or asylum-based AOS.
- (a)(12) / (c)(19) — Temporary Protected Status (TPS) initial / renewal. Designations vary by country and re-designation date.
- (c)(33) — DACA (Deferred Action for Childhood Arrivals) initial / renewal.
- (c)(11) — Parolee (humanitarian parole, U4U, CHNV parolees).
- (a)(18) — Spouse of L-1 intracompany transferee.
- (c)(26) — Spouse of H-1B with approved I-140.
- (c)(14) — Deferred action recipient.
- (c)(16) — Self-petitioning religious worker, Special Immigrant Juvenile, etc.
What we need from you for I-765
- Biographic information (legal name, prior names, DOB, country of birth, country of citizenship)
- SSN if previously issued, or SSA card request via the I-765 itself
- Current and prior U.S. addresses
- Most recent I-94 or admission record; passport biographic page; any prior EAD
- Evidence of the eligibility category (pending I-589 receipt for (c)(8), pending I-485 for (c)(9), TPS registration for (a)(12), etc.)
- Two passport-style photos (we provide the spec)
Filing fee and fee waiver
The I-765 filing fee depends on category and whether it is filed with concurrent I-485 — some categories pay no separate fee when filed with the underlying form. Form I-912 fee waiver is available for applicants below the income threshold or receiving certain means-tested benefits. We prepare the I-912 when it applies.
