Form SC-100, the Plaintiff’s Claim and ORDER, opens a small-claims case. Small claims uses a simplified procedure where the parties represent themselves; lawyers may not represent a party at the first hearing, and filing fees are low.
Limits and where to file
- An individual can sue for up to $12,500; corporations and other entities are limited to $6,250.
- A person cannot file more than two claims over $2,500 anywhere in the state in one calendar year.
- File in the proper venue — usually where the defendant lives, where the contract was made or performed, or where the harm happened.
