Proof of Service (SC-104) tells the court that the other side received the claim properly and in time. If service is missing or late, the hearing is usually postponed or the case dismissed — so correct service is essential.
How a defendant can be served
- By the sheriff or marshal, by a registered process server, or by any adult who is not a party.
- By certified mail (with restricted delivery) handled by the court clerk, where allowed.
- Service must be completed at least 15 days before the hearing (20 days if the defendant is outside the county).
What we prepare
- SC-104 Proof of Service and the matching SC-104 series for the method used.
- Service instructions and the packet for the sheriff or process server.
What we do NOT do
Imverica is a registered California Legal Document Assistant — not a law firm, and not a process server. We prepare the proof-of-service forms at your direction; the actual service is done by the sheriff, a registered server, or another eligible adult. We do not give legal advice. For advice we maintain referrals to licensed attorneys.
Authority: California Code of Civil Procedure §116.330 (hearing date and service timing) and §116.340 (methods of service). Document preparation only — not legal advice.
