A wage garnishment (Earnings Withholding Order) directs a debtor’s employer to withhold part of each paycheck and send it to the sheriff until a judgment is paid. It is one of the most effective ways to collect from a debtor who is employed but will not pay voluntarily.
How it works
- You give the sheriff a Writ of Execution (EJ-130) and the WG-001 application; the sheriff serves the Earnings Withholding Order on the employer.
- The employer withholds the allowed amount each pay period (state and federal limits protect part of the debtor’s wages).
- Some income is exempt, and the debtor can claim a hardship exemption.

- The instruction packet for the sheriff or levying officer.
