SC-120 — Defendant’s Claim (counter-sue)

Form SC-120, the Defendant’s Claim, lets a defendant who is being sued in small claims file their own related claim against the plaintiff so both are decided at the same hearing — saving a separate case.

Timing and limits

  • File and serve the SC-120 before the hearing — generally at least 5 days before (more if you were served fewer than 10 days before).
  • The same dollar limits apply ($12,500 for individuals; $6,250 for entities).
  • Your claim must be related to or arise from the plaintiff’s claim.
